Terms of Service

1. Overview

These Terms of Service ("Terms") govern your access to and use of the DeskDrop website, the DeskDrop gifting service, the pilot offering, and any related CRM extensions or software (collectively, the "Service"), operated by DeskDrop ("DeskDrop", "we", "us"). By purchasing a pilot, placing an order, or otherwise using the Service, you agree to these Terms on behalf of yourself and the organization you represent.

2. The Service

DeskDrop produces custom-branded physical gifts and ships them to recipients you designate, and provides software to initiate and track those sends, including optional integrations with third-party CRMs such as HubSpot and Salesforce. We do not control whether a recipient accepts, opens, or responds to a gift, and we make no guarantee of any business outcome, reply rate, meeting, or return on investment. Any figures presented on our site are illustrative or reflect our own or aggregated experience and are not a promise of results.

3. Pilot and orders

The pilot is a one-time purchase of a fixed number of prepaid sends at the price shown at checkout, inclusive of one-time artwork setup. Additional sends after the pilot are billed at the then-current per-gift rate. Prices are in U.S. dollars and exclusive of any applicable taxes. We will produce a design proof for your approval before printing or shipping; production timelines begin upon proof approval and are estimates, not guarantees.

4. Payment

Payments are processed by Stripe, Inc. We do not store your full card details. By submitting payment you authorize the charge shown at checkout. You are responsible for providing accurate billing and recipient information.

5. Refunds and cancellations

You may cancel a pilot order for a full refund any time before you approve the design proof. Once a proof is approved and production has begun, the order is non-refundable because the goods are custom-made to your specification. Prepaid sends that remain undeployed do not expire during an active engagement; contact us regarding any unused balance. Nothing here limits rights you may have under applicable law.

6. Your content and brand license

To fulfill your order you will provide logos, marks, messaging, and recipient data ("Your Content"). You grant DeskDrop a limited, non-exclusive license to use Your Content solely to design, produce, ship, and support your gifts and campaigns. You represent that you own or have the right to use Your Content and to authorize us to print your logo and to ship to the recipients you provide, and that doing so does not violate any law or third-party right. You are responsible for ensuring your gifting complies with the recipient’s organization’s gift policies and any applicable anti-bribery, privacy, and marketing laws.

7. Acceptable use

You agree not to use the Service to send unlawful, deceptive, harassing, or infringing materials, to send gifts that would violate a recipient’s policies or applicable law, or to interfere with or attempt to gain unauthorized access to the Service or its integrations.

8. Third-party integrations

CRM and other integrations are provided subject to the applicable third party’s terms. We are not responsible for third-party platforms, their availability, or changes they make. Your use of any integration is at your discretion.

9. Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, DeskDrop’s total liability arising out of or relating to the Service will not exceed the amount you paid to DeskDrop in the twelve months preceding the claim, and DeskDrop will not be liable for indirect, incidental, or consequential damages.
